Trusts and estate planning in Cape Town

A trust or an estate plan is only as good as its tax and administration. We set up and run trusts, draft the plan with your will, and model what your estate will owe so your family isn't surprised.

In short: Dynamic Group SA helps families and business owners decide whether a trust is right for them, registers it with the Master of the High Court and SARS, and keeps it compliant every year. For estate planning, a CFP® professional maps your assets, estimates estate duty, capital gains tax on death and executor costs, and recommends changes to your will, ownership structures and cover.

When a trust makes sense

  • Protecting property or a business from personal creditors
  • Providing for minor children or a dependant with special needs
  • Keeping family assets together across generations
  • Managing assets for family members living in different countries

A trust is not automatically a tax saving. Interest-free loans to a trust, distributions and capital gains all have specific tax rules. We model the tax before you sign anything.

What an estate plan should answer

  • What will your estate owe in estate duty and capital gains tax?
  • Is there enough cash to pay those costs without selling the family home?
  • Who looks after your children, and who manages their inheritance?
  • How are assets in another country, or a spouse from another country, handled?
  • Is your will valid, current and consistent with your marriage contract?

Trust and estate questions

Does a trust have to submit a tax return?

Yes. A trust is a taxpayer in its own right and must be registered with SARS and submit an ITR12T return each year, whether or not it earned income. Trustees also need to keep the trust's beneficial ownership information up to date with the Master of the High Court.

What is section 7C and does it affect my trust?

Section 7C of the Income Tax Act applies when a person lends money to a trust interest-free or below the official rate of interest. The interest not charged can be treated as a donation each year, which may attract donations tax. We review loan accounts and recommend how to structure or reduce them.

How is an estate taxed in South Africa?

Three costs usually apply: capital gains tax on assets treated as disposed of at death, estate duty on the net value of the estate above the abatement, and executor and administration costs. Assets left to a surviving spouse are treated differently. We estimate each one for your estate.

Can you act as an independent trustee?

Yes, where it suits the trust. An independent trustee helps show that the trust is properly administered and not simply an extension of the founder, which matters for both the Master and SARS.

I live abroad but own property in South Africa. Can you help?

Yes. We plan for assets held in South Africa by non-residents and for South Africans with assets offshore, including the tax position in South Africa when those assets pass on. See also expat and foreign income tax.
